Notice of an Amendment to Directive 5 of 2018

The Malta Gaming Authority (the ‘Authority’) hereby notifies all B2C licensees that it shall repeal Article 13 of the Alternative Dispute Resolution Directive (Directive 5 of 2018) (the ‘Directive’), effective from 20 July 2025.

Article 13 of the Directive currently mandates all online B2C licensees to include information relating to, and a link to, the Online Dispute Resolution (ODR) Platform within their general terms and conditions.

The amendment follows the adoption of Regulation (EU) 2024/3228 (the ‘EU Regulation’), which repeals Regulation (EU) No 524/2013 and provides for the discontinuation of the ODR Platform.

Considering this development, all B2C licensees are directed to ensure that any references to the ODR Platform are removed from their terms and conditions on the effective date, to avoid misleading players. Furthermore, B2C licensees are advised to refer to the EU Regulation to ensure compliance with any obligations arising therefrom.
